Legal
Terms & Conditions.
The terms that govern your use of this Site, our Services and our software Products.
Last updated: 7 October 2026
These Terms & Conditions ("Terms") govern your access to and use of the website bettr.studio (the "Site"), the branding, web design, and marketing services (the "Services"), and the software products we operate, including ContentPlanner (content.agentparker.co) and Placony (placony.com) (the "Products"), all provided by Bettr Branding and Marketing LLP, a limited liability partnership registered at 213/208, G Block, Rajendra Park, Gurgaon, Haryana 122001, India ("Bettr", "we", "us", or "our"). By using the Site, engaging our Services, or subscribing to a Product, you agree to these Terms.
We work with clients based in India, the United Kingdom, the European Union, the United States, and elsewhere. Nothing in these Terms limits any statutory rights you may have as a consumer under the mandatory laws of your country of residence.
1. Use of this Site
You may browse the Site for informational purposes and to enquire about our Services and Products. You agree not to misuse the Site, including by attempting to gain unauthorised access to it, interfering with its operation, or using it to transmit unlawful or harmful content.
2. Intellectual property
All content on the Site — including text, graphics, logos, case studies, and design work — and the Products themselves (software, interfaces, and documentation) are owned by or licensed to Bettr and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for personal, non-commercial viewing.
3. Engagement of Services
Specific project scope, deliverables, timelines, and fees for branding, web design, conversion UX, packaging, and marketing engagements are set out in a separate proposal, statement of work, or agreement signed or accepted by both parties ("Project Agreement"). Where these Terms conflict with a Project Agreement, the Project Agreement takes precedence for that engagement.
4. Software Products (SaaS)
Our Products are provided as online subscription services. Each Product may have its own terms of service and privacy policy, available on that Product's website, which apply in addition to these Terms; if they conflict for that Product, the Product's own terms prevail.
- Accounts. You must provide accurate information, keep your login details secure, and are responsible for activity under your account.
- Subscriptions and billing. Paid plans are billed in advance, monthly or annually as selected, at the price shown at checkout. Unless you cancel, a subscription renews automatically at the end of each billing period. Usage-based charges (for example voice minutes beyond your plan) are billed as described on the Product's pricing page.
- Free trials. If a trial is offered you will not be charged before it ends; if you do not cancel before the trial ends, your paid plan begins and you will be charged.
- Cancellation. You can cancel at any time from your account's billing page or by emailing us. Cancellation stops future renewals; access continues until the end of the period already paid for. See our Refund & Cancellation Policy.
- Acceptable use. You must not use a Product for anything unlawful, deceptive, abusive, or to send spam, and must not attempt to break, overload, resell or reverse engineer it. For Products that contact people (such as automated calls or messages), you are responsible for having the consent required by applicable law, including telecom and do-not-disturb rules, before you give us anyone's contact details.
- AI-generated output. Output from AI features is a suggestion. You are responsible for reviewing it before relying on or publishing it.
- Availability. We work to keep the Products reliable but provide them "as is" and "as available". We may change features and may suspend accounts that breach these Terms.
5. Fees, payment & currency
Fees are as set out in the applicable Project Agreement, invoice, or the Product's pricing page. Most Services projects require an upfront deposit or advance payment before work begins, with the remaining balance invoiced in milestones or upon completion, as set out in your Project Agreement. Unless otherwise agreed in writing, invoices are payable within the timeframe stated on the invoice. We reserve the right to pause work on any project, or restrict access to a Product, where payment is significantly overdue.
Payments are processed by third-party payment partners such as Cashfree Payments (for UPI, cards, and net banking in India) and PayPal or bank transfer (for international payments). We do not store your full card number or banking credentials. Transactions are processed in Indian Rupees (INR), US Dollars (USD), or British Pounds (GBP) depending on your location and the payment method used; the applicable currency and amount are always confirmed on your invoice or checkout page before payment. Prices are exclusive of applicable taxes (such as GST in India, or VAT in the UK/EU) unless stated otherwise.
6. Refund & cancellation policy
Our full policy for Services and for Product subscriptions is set out on the Refund & Cancellation Policy page, which forms part of these Terms. To request a cancellation or refund, email anshul.mittal@bettr.studio with your invoice, order, or account reference.
7. Delivery
Our Services and Products are delivered digitally; we do not ship physical goods. See our Delivery Policy for when and how access and deliverables are provided.
8. Client responsibilities
You agree to provide timely feedback, content, brand assets, and approvals reasonably required for us to deliver the Services, and to ensure that any materials or data you supply to us or put into a Product do not infringe the rights of any third party or break any law.
9. Ownership of deliverables and your content
Unless otherwise agreed in a Project Agreement, final approved deliverables (such as brand identities, packaging designs, and website files) transfer to the client upon full payment of all fees due for that project. We retain the right to display completed work in our portfolio and marketing materials, unless you request otherwise in writing (for example, where a non-disclosure agreement applies). Content and data you add to a Product remains yours; you give us permission to store and process it only as needed to provide the Product to you.
10. Third-party platforms
Our Services and Products may involve third-party platforms (such as hosting providers, CMS platforms, social networks, telephony and AI model providers, or advertising networks like Meta/Facebook Ads). Your use of those platforms is subject to their own terms, and we are not responsible for their availability, pricing, or policy changes.
11. Limitation of liability
To the maximum extent permitted by applicable law, Bettr's total liability arising from or in connection with the Services or Products is limited to the fees paid by you for the specific project or, for a Product, in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential losses, including loss of profits, revenue, data, or business opportunity. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or death or personal injury caused by negligence.
12. Confidentiality
Each party agrees to keep confidential any non-public business, financial, or technical information disclosed by the other in connection with a project, and to use it only for the purposes of that project.
13. Termination
Either party may terminate an ongoing project in accordance with the terms of the applicable Project Agreement. You may stop using a Product at any time. We may suspend or end access to a Product for breach of these Terms. Upon termination, you are responsible for paying for work completed or access used up to the date of termination, and the Refund & Cancellation Policy applies to any advance payments held.
14. Governing law
These Terms are governed by the laws of India, and the courts at Gurugram, Haryana shall have exclusive jurisdiction, save that this does not remove any mandatory consumer-protection rights or dispute-resolution mechanisms available to clients under the laws of England & Wales, the European Union, or the United States where such laws apply and cannot be excluded by agreement.
15. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site, a Product, or ongoing engagement of our Services after changes are posted constitutes acceptance of the revised Terms. Material changes affecting an active Project Agreement or a paid subscription will be communicated to you directly.
