These Terms & Conditions ("Terms") govern your access to and use of the website bettr.studio (the "Site") and the branding, web design, and marketing services (the "Services") provided by Bettr Branding and Marketing LLP, a limited liability partnership registered at 213/208, G Block, Rajendra Park, Gurgaon, Haryana 122001, India ("Bettr", "we", "us", or "our"). By using the Site or engaging our Services, you agree to these Terms.

We work with clients based in India, the United Kingdom, the European Union, the United States, and elsewhere. Nothing in these Terms limits any statutory rights you may have as a consumer under the mandatory laws of your country of residence.

1. Use of this Site

You may browse the Site for informational purposes and to enquire about our Services. You agree not to misuse the Site, including by attempting to gain unauthorised access to it, interfering with its operation, or using it to transmit unlawful or harmful content.

2. Intellectual property

All content on the Site — including text, graphics, logos, case studies, and design work — is owned by or licensed to Bettr and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for personal, non-commercial viewing.

3. Engagement of Services

Specific project scope, deliverables, timelines, and fees for branding, web design, conversion UX, packaging, and marketing engagements are set out in a separate proposal, statement of work, or agreement signed or accepted by both parties ("Project Agreement"). Where these Terms conflict with a Project Agreement, the Project Agreement takes precedence for that engagement.

4. Fees, payment & currency

Fees are as set out in the applicable Project Agreement or invoice. Most projects require an upfront deposit or advance payment before work begins, with the remaining balance invoiced in milestones or upon completion, as set out in your Project Agreement. Unless otherwise agreed in writing, invoices are payable within the timeframe stated on the invoice. We reserve the right to pause work on any project where payment is significantly overdue.

Transactions are processed in Indian Rupees (INR), US Dollars (USD), or British Pounds (GBP) depending on your location and the payment method used; the applicable currency and amount are always confirmed on your invoice or checkout page before payment. Prices are exclusive of applicable taxes (such as GST in India, or VAT in the UK/EU) unless stated otherwise.

5. Refund & cancellation policy

If you cancel a project before we have started any work, you will receive a full refund of any advance or deposit paid. Once work has begun on a project, fees for work already completed are non-refundable; any portion of an advance payment that corresponds to milestones not yet started remains refundable on request. Refunds, where due, are processed to the original payment method within 7–10 business days of the cancellation request.

6. Client responsibilities

You agree to provide timely feedback, content, brand assets, and approvals reasonably required for us to deliver the Services, and to ensure that any materials you supply to us do not infringe the rights of any third party.

7. Ownership of deliverables

Unless otherwise agreed in a Project Agreement, final approved deliverables (such as brand identities, packaging designs, and website files) transfer to the client upon full payment of all fees due for that project. We retain the right to display completed work in our portfolio and marketing materials, unless you request otherwise in writing (for example, where a non-disclosure agreement applies).

8. Third-party platforms

Our Services may involve third-party platforms (such as hosting providers, CMS platforms, or advertising networks like Meta/Facebook Ads). Your use of those platforms is subject to their own terms, and we are not responsible for their availability, pricing, or policy changes.

9. Limitation of liability

To the maximum extent permitted by applicable law, Bettr's total liability arising from or in connection with the Services is limited to the fees paid by you for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profits, revenue, or business opportunity. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or death or personal injury caused by negligence.

10. Confidentiality

Each party agrees to keep confidential any non-public business, financial, or technical information disclosed by the other in connection with a project, and to use it only for the purposes of that project.

11. Termination

Either party may terminate an ongoing project in accordance with the terms of the applicable Project Agreement. Upon termination, you are responsible for paying for work completed up to the date of termination, and Section 5 (Refund & cancellation policy) applies to any advance payments held.

12. Governing law

These Terms are governed by the laws of India, and the courts at Gurugram, Haryana shall have exclusive jurisdiction, save that this does not remove any mandatory consumer-protection rights or dispute-resolution mechanisms available to clients under the laws of England & Wales, the European Union, or the United States where such laws apply and cannot be excluded by agreement.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site or ongoing engagement of our Services after changes are posted constitutes acceptance of the revised Terms. Material changes affecting an active Project Agreement will be communicated to you directly.
